1. Acceptance of Terms

By accessing or using Latexy ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Latexy is an AI-powered ATS (Applicant Tracking System) resume optimizer that helps users create professional, ATS-friendly resumes using LaTeX compilation and artificial intelligence optimization.

2.1 Service Features

  • LaTeX resume compilation to PDF
  • AI-powered resume optimization
  • ATS compatibility scoring
  • Resume history and version management
  • Multi-LLM provider support (BYOK - Bring Your Own Key)
  • Real-time collaboration and editing

3. User Accounts and Registration

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

  • You must be at least 16 years old to use the Service
  • You must have the legal capacity to enter into this agreement
  • Corporate accounts must be created by authorized representatives

4. Subscription Plans and Billing

4.1 Plan Types

  • Free Trial: 3 free resume compilations per device (no registration required)
  • Basic Plan: ₹299/month - 400 compilations, 10 optimizations
  • Pro Plan: ₹599/month - Unlimited compilations and optimizations
  • BYOK Plan: ₹199/month - Use your own API keys with premium features

4.2 Billing Terms

  • Subscription fees are billed monthly in advance
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension

4.3 Free Trial Terms

  • Limited to 3 compilations per device using browser fingerprinting
  • No credit card required for trial access
  • Trial usage resets every 24 hours for abuse prevention
  • Converting to paid plan removes all usage limitations

5. Acceptable Use Policy

5.1 Permitted Uses

  • Creating professional resumes and CVs
  • Optimizing resume content for job applications
  • Educational and career development purposes
  • Personal and commercial use within subscription limits

5.2 Prohibited Uses

  • Uploading malicious code or content
  • Attempting to reverse engineer the Service
  • Violating intellectual property rights
  • Sharing account credentials with unauthorized users
  • Using the Service for illegal activities
  • Circumventing usage limits or security measures

6. Intellectual Property Rights

6.1 Service Content

  • Latexy retains all rights to the Service, including software, algorithms, and documentation
  • Users retain ownership of their resume content and personal data
  • AI-generated optimizations are provided as suggestions, not guaranteed outcomes

6.2 User Content

  • You retain ownership of resumes and content you create
  • You grant Latexy a limited license to process your content for service provision
  • We do not claim ownership of your personal information or resume content

7. Privacy and Data Protection

7.1 Data Collection

  • We collect information necessary to provide the Service
  • Personal data is processed according to our Privacy Policy
  • Resume content is processed for optimization but not stored permanently
  • API keys (BYOK) are encrypted and stored securely

7.2 Data Security

  • We implement industry-standard security measures
  • Data is encrypted in transit and at rest
  • Regular security audits and vulnerability assessments
  • Incident response procedures for data breaches

8. API Key Management (BYOK)

8.1 User Responsibilities

  • Users are responsible for their own API key security
  • API key costs are separate from Latexy subscription fees
  • Users must comply with third-party provider terms (OpenAI, Anthropic, etc.)
  • Latexy is not liable for API key misuse or associated costs

8.2 Supported Providers

  • OpenAI (GPT-4, GPT-3.5-turbo)
  • Anthropic (Claude-3 variants)
  • Google (Gemini Pro models)
  • OpenRouter (multiple model access)

9. Service Availability and Performance

9.1 Uptime Commitment

  • We strive for 99.9% service availability
  • Scheduled maintenance will be announced in advance
  • No SLA guarantees for free trial users

9.2 Performance Standards

  • Target response time: <2 seconds for compilation requests
  • PDF generation: <5 seconds for typical resumes
  • LLM optimization: <30 seconds for complex resumes

10. Limitation of Liability

10.1 Service Disclaimer

  • The Service is provided "as is" without warranties
  • We do not guarantee job placement or interview success
  • AI optimizations are suggestions, not professional career advice
  • Users are responsible for final resume content and accuracy

10.2 Liability Limits

  • Our liability is limited to the amount paid for the Service
  • We are not liable for indirect, consequential, or punitive damages
  • Force majeure events excuse performance delays or failures

11. Termination

11.1 Termination by User

  • Users may cancel subscriptions at any time
  • Account data will be retained for 30 days after cancellation
  • No refunds for unused subscription periods

11.2 Termination by Latexy

  • We may terminate accounts for Terms violations
  • Immediate termination for illegal activities or security threats
  • 30-day notice for non-payment or policy violations

12. Dispute Resolution

12.1 Governing Law

  • These Terms are governed by Indian law
  • Disputes will be resolved in courts of Bangalore, India
  • Arbitration may be required for certain disputes
